1. Eligibility
You must be at least 13 years old, or the minimum age required in your country, to use the Services. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms for you.
2. Accounts
You are responsible for the activity on your account and for keeping your sign-in credentials secure. Information you provide must be accurate and must not impersonate another person. Tell us promptly if you believe your account has been compromised.
You may not sell, transfer, rent, or share an account in a way that compromises security or bypasses restrictions in the Services.
3. Limited license
Subject to these Terms, Towerscape grants you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Services for non-commercial entertainment purposes.
You may not copy, modify, distribute, sell, lease, reverse engineer, interfere with, or attempt to gain unauthorized access to the Services, except where applicable law does not allow that restriction.
4. Player conduct
When using the Services, you may not:
- harass, threaten, defraud, or harm another person;
- post unlawful, hateful, sexually explicit, infringing, or intentionally disruptive content;
- cheat, exploit bugs, automate play, use unauthorized software, or manipulate gameplay or rewards;
- attempt to access another person’s account or non-public systems;
- disrupt servers, evade moderation, or interfere with another player’s experience; or
- use the Services for unlawful or unauthorized commercial activity.
We may investigate suspected violations and take reasonable action to protect players and the Services.
5. Player content
You keep ownership of content you submit, such as profile text and chat messages. You grant Towerscape a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, and distribute that content only as needed to operate, improve, moderate, and promote the Services.
You represent that you have the rights needed to submit your content. We may remove or restrict content that violates these Terms or could harm players or the Services.
6. Virtual items and purchases
The Services may include virtual currency, items, memberships, or other digital benefits. They are licensed, not sold; have no cash value; and cannot be redeemed outside the Services unless we expressly say otherwise.
Purchases may be processed by an app store or payment provider and are subject to that provider’s terms. Except where required by law or platform rules, purchases are final and non-refundable. We may change, rebalance, or discontinue virtual items or features as the Services evolve.
7. Health and wellness notice
Towerscape may help you track time spent on real-world skills or activities, but it does not provide medical, fitness, or professional advice. Use good judgment, follow safety guidance for any activity, and consult a qualified professional when appropriate. Stop an activity if you feel pain, illness, or unsafe.
8. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or if needed to protect the Services or other people. Where reasonable, we will provide notice. Provisions that by their nature should continue after termination will survive.
9. Towerscape property
The Services, including their software, game systems, characters, artwork, music, names, logos, and other content, are owned by Towerscape or its licensors and protected by intellectual-property laws. No rights are granted except the limited license stated in these Terms.
If you send ideas or feedback, you allow us to use them without restriction or compensation to you.
10. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Towerscape disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Services will always be available, secure, or error-free, or that progress or content will never be lost.
11. Limitation of liability
To the fullest extent permitted by law, Towerscape and its affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from the Services.
Nothing in these Terms limits liability that cannot legally be limited. Your local law may give you rights that these Terms cannot exclude.
12. General terms
We may update these Terms as the Services change. We will post the revised Terms and update the effective date. If a change is material, we will provide additional notice when required. Your continued use after the updated Terms take effect means you accept them.
If any provision is unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or sale of assets.
